This Hosting Agreement (“Agreement”) is made and entered into by and between Hosterlo, a company incorporated under the laws of USA, (“Hosterlo”), and you, the user (“You”).

This Agreement sets forth the terms and conditions for your use of Hosterlo’s hosting services (“Services”). By using the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement, along with our Universal Terms of Service Agreement, which is incorporated herein by reference, and any other agreements or policies that are expressly incorporated herein.

1. Description of Services

2. Limitations; Account Termination

• Server Migration: You acknowledge that IP addresses may change during server migrations.
• Termination: Upon termination, you must discontinue using the Services, relinquish IP addresses and server names, and move your website content. We will not transfer or FTP your content.
• Free Products: Upon termination, all free products will be cancelled.

3. Your Obligations

• Abusive Activities: You are prohibited from using our servers for abusive activities, including mail bombs, denial-of-service attacks, hacking, and public DNS services.
• Storage and Security: You are responsible for maintaining backups, ensuring security, and complying with data protection regulations (GDPR).
• Website/Server Content: You are responsible for providing, updating, and maintaining your website content, including compliance with applicable laws and taxes.
• Templates: Templates provided by Hosterlo are for illustrative purposes only and do not constitute legal advice.
• Third-Party Services: You are responsible for managing and maintaining any paid subscriptions with third-party providers integrated into your website.

4. Provisions Specific to Web Hosting

• Storage and Plan Limits: Resource limitations apply to all plans, including shared hosting. Exceeding limits may result in service slowdowns, suspension, or upgrades.
• Website/Server Content: Certain content is prohibited, including image hosting scripts, banner ad services, file dumps, commercial audio streaming, push button mail scripts, anonymous SMS gateways, backups from other sites, Bittorrent trackers, and scripts harming server performance.
• Unlimited Services: While resources are not capped, fair usage applies to prevent service instability. We may request reduced usage, upgrades, or resource restrictions if your site exceeds typical small business website usage.

5. Provisions Specific to VPS

• cPanel: If you add cPanel, you agree to be bound by the cPanel EULA.

6. Service Uptime Guarantee

We offer a 99.9% uptime guarantee. If we fail to meet this guarantee, you may request a 5% credit for that month’s hosting fee. Exclusions apply, including planned maintenance, custom scripting, outages not affecting website appearance, external causes, and violations of our terms. Claims must be made within 30 days of the interruption.

7. Money Back Guarantee

Products and services eligible for refunds are described in our Refund Policy.

8. Third-Party Software

• Definition: Third-party software is developed and owned by third-party providers we contract with.
• Operating Software: We reserve the right to modify, change, or discontinue any third-party software.
• Your Use: You may use the software solely as part of the Services and agree to the terms of any service or license agreement from the third-party provider.
• Support: We provide support for the third-party software, not the third-party providers themselves.

9. Titles and Headings; Independent Covenants; Severability

The titles and headings are for convenience only and do not affect the interpretation of this Agreement. Each covenant is independent. If any provision is held to be invalid, the remaining provisions will remain in full force and effect.

10. Definitions; Conflicts

Capitalized terms not defined herein have the meanings ascribed to them in the Universal Terms of Service Agreement. In the event of a conflict between this Agreement and the Universal Terms of Service Agreement, the provisions of this Agreement shall control.
